BABAA Compliance

What is BABAA?
BABAA (Build America, Buy America Act) is a US federal requirement that infrastructure projects use American-made products. Agencies cannot obligate funds unless all iron, steel, manufactured products, and construction materials are produced in the United States, unless otherwise specified. BABAA compliance creates a significant competitive advantage for suppliers in federal contracting.



What Does BABAA Require?

  • Iron and Steel:All steel used in enclosures must be produced domestically, from initial melting through forming, welding, and finishing
  • Manufactured Products:Must be manufactured in the US with over 55% of components (by cost) sourced domestically
  • Construction Materials:All manufacturing processes must occur in the United States
  • Documentation:Maintain manufacturer certifications and compliance records for at least three years


Waiver Process
Waivers may be granted when requirements conflict with public interest, materials aren't available domestically in sufficient quantity or quality, or compliance increases project costs by more than 25%. The process involves a 5-step submission through federal agencies and the Made in America Office.
